I. INTRODUCTION:
The Wyldistan mobile application/s, website/s, and mobile site/s (hereinafter referred to as “Wyldistan” or “the Platform”), is created, owned and operated by Otobic Consulting LLP, being a Limited Liability Partnership under the laws of India (hereinafter referred to as the “Contracting Entity”). Wyldistan offers travel-related services through the Platform and are committed to providing the best user experience for anyone who uses the Platform. For the purposes of this Privacy Policy, wherever the context so requires, the terms “you” and “your” shall mean the User and the terms “we”, “us” and “our” shall mean Wyldistan, being the Platform. Please refer to Glossary and Definitions to view relevant terms and their definitions. You can find out more about the Contracting Entity, including which company makes decisions about how your information is handled, by contacting us at support@wyldistan.com.
At Wyldistan, we recognise the importance of privacy of our users and also of maintaining confidentiality of the information provided by our users as a responsible data collector and data processor. We take your privacy seriously and are committed to protecting and safeguarding your privacy in accordance with our Privacy Policy and Cookie Policy as well as the laws related to privacy and data protection.
This Privacy Policy describes how we handle your personal data/information that is furnished to the Platform. Please also read our Cookie Policy , which tells you how we use cookies and other similar tracking technologies.
By agreeing to this Privacy Policy, you are providing Wyldistan with your explicit consent to process your personal information/data specified herein for the purposes defined in this Policy. By using or accessing our Platform, as a User you hereby agree with the terms of this Privacy Policy and the contents herein. If you have any concerns in the processing of your information and wish to withdraw your consent, you may do so by writing to us at support@wyldistan.com. However, if such processing is essential for us to be able to provide services to you, then we may not be able to serve you or confirm your Reservations/Bookings after such withdrawal of your consent. If you disagree with this Privacy Policy during initial registration as a User, please do not proceed with the registration process to access and use our Platform.
Please note that the information/data shared with our Platform may be processed by us, our Service Provider/s, and/or our vendors in India or globally, where such information/data is processed. The data protection regulations in India or any such other jurisdictions mentioned above may differ from those of your country of residence.

II. SCOPE OF OUR PRIVACY POLICY:
This Privacy Policy applies to anyone who interacts with our Platform via any channel, including users who make use of the Facilitation Service provided by our Platform, its features and services and the products and services listed on the Platform for activities including but not limited to when a user signs up with Wyldistan, modifies their account, requests value-added services, contacts customer support, or otherwise communicates or interacts with Wyldistan.
This Privacy Policy describes what personal data/information we collect and how we collect, process, transfer, use and store such data, regardless of the way users contact us (e.g. mobile application, website, email, phone call, etc.). Sometimes we may provide users with additional information or privacy notice/s from time to time if required for specific interactions, based on the mode of interaction and use of a particular functionality on our Platform.
This Privacy Policy does not apply to any mobile application/s, website/s, and mobile site/s of third-parties, even if their products and services are linked to our Platform. The User shall take note to review the privacy statements and policies of such third parties with whom they may interact.

III. WHAT TYPE OF PERSONAL INFORMATION DO WE COLLECT?
We obtain personal information provided by you while registering on our Platform and during your usage of the Platform. To facilitate Reservations/Bookings of products and services listed on our Platform, we are required to collect such personal information about you and/or the individuals included as Guests in your Reservations/Bookings as without it we may not be able to provide all services requested. This information includes but is not limited to names, contact details, email address, date of birth, gender, marital status, age, photo and government issued identification for you and/or the individuals included as Guests in your Reservations/Bookings. Any payment information (e.g. banking details, credit card information) that you provide to the Payment Gateway to complete your Reservation/Booking will not be collected or stored by Wyldistan, however this would be collected, processed and/or stored by the external Payment Gateway Provider for such transaction. To understand how they will use your payment information, please review the Payment Gateway Provider’s privacy policy . You may also decide to provide us additional personal information as may be required for the use of our Platform.
If any information such as contact information or other personal information belonging to another person who may or may not be included as a Guest in the Reservations/Bookings is shared by you as the registered User on the Platform, you hereby certify that you have permission to provide that information to Wyldistan for the purposes described in this Privacy Policy and that you have shared this Privacy Policy with such individual/s. If you provide a payment instrument and/or contact information belonging to another person to the external Payment Gateway for completing a transaction with Wyldistan, it shall be deemed that you have permission to provide that information to the Payment Gateway and that you have shared the Payment Gateway Provider’s privacy policy with such individuals.
We obtain personal information from you through your interactions with us, including by telephone, email, via our websites, applications, or any other medium. In addition to this, we also collect non-personally identifiable information from computers, phones, tablets or any other devices you use to access our Platform. Such information includes but is not limited to hardware and software information such as IP address, cache data, browser and/or device settings and preferences and geolocation information.
There may also be situations where we may collect some other information and documents including but not limited to:
● Usernames, passwords, email addresses and other security-related information used by you in relation to our Platform;
● Transactional information and history (other than banking details) and information about your e-commerce activities, buying behaviour and preferences towards products and services;
● Usage information such as searches for Listings, bookings made in the past, access dates and times, pages viewed or engaged with before or after using our Platform, and other actions on our Platform, including the pages or content you view and links you click to third-party applications;
● Data either created by you or by a third party and which you wish to store on our servers such as image files, documents, etc.;
● Data available in public domain or received from any third party including social media channels, including but not limited to personal or non-personal information from your linked social media channels (like name, email address, friend list, profile pictures or any other information that is permitted to be received as per your account settings) as a part of your account information;
● Information pertaining to any other Guest/s for whom you make a Reservation/Booking through your registered User account. In such case, you must confirm and represent that each of the Guests for whom a Reservation/Booking has been made, has agreed to have the information shared by you disclosed to us and further be shared by us with the concerned Service Provider/s;
● If any personal data of a minor is provided to our Platform (for example: where a minor is accompanying as a Guest during a Reservation/Booking), it is deemed that the Customer has or has obtained the necessary parental or guardian consent to provide such information to our Platform. If we are made aware that personal data of a minor is shared with our Platform without the necessary parental consent, we will take steps to delete such data upon actual knowledge. If the parents or guardians of the minor want any personal data of a minor to be removed from the Platform, they may contact us at support@wyldistan.com;
● In case of Service Provider/s in India and any such other jurisdictions where a Service Provider engaged by us may process information, to the extent permitted by applicable laws, we may perform background checks and obtain reports and other information about the Service Provider/s and/or their background;
● In case of international Reservations/Bookings, any additional information and documents as may be required to ensure compliance with any regulations/laws or any such information required by Service Provider/s.
The aforementioned data/information collected from Users shall be strictly used for the aforesaid specified and lawful purposes only, and will not be shared without prior consent of the User unless otherwise required by any law enforcement authority for investigation, by court order or in reference to any legal process.
The User further consents and understands that we may share this information with the Service Provider/s or any other third-party for the provision and facilitation of the desired Reservations/Bookings. In case a User does not wish to provide this information or opts for deletion or withdrawal of the information already provided, the User may do so by writing to us at support@wyldistan.com, however in such case Wyldistan may not be able to process the desired Reservation/Booking request.

IV. WHY DO WE COLLECT YOUR PERSONAL INFORMATION?
We obtain personal information to provide you access to our Platform, to help you find travel products and services listed on our Platform, to provide and facilitate Reservations/Bookings and to share the same with Service Provider/s and customer support teams to assist you in Reservations/Bookings to ensure you get the best service possible for your trip. We also use your personal information to contact you about the latest deals, special offers and other products or services we think you might be interested in. We may utilise and process such personal information for other purposes which are further described hereinafter.
We process your personal information for the purposes set out in this Privacy Policy, based on the legal grounds and requirements set out below depending on what category of personal information we process. Standard personal information is normally processed by us on the basis that it is necessary for accessing the application or website via login, the performance of contract, our or third parties’ legitimate interests, obligations towards Service Provider/s, or as required under law. Additionally, any information falling under the special category processed by us will be as per the grounds set out below:
● we have your consent;
● you have manifestly made it public;
● processing is necessary for reason/s required under law, including establishment, exercise, or defence of legal claims.
We process your personal information for various legitimate interests which are listed herein below:
● to provide and administer our products and services and to facilitate those listed by our Service Provider/s;
● to send you Reservation/Booking related communications including confirmations, invoices, etc.;
● to provide support related your account, Reservations/Bookings, facilitation of payments and other queries and requests;
● to administer our relationship with you and our Service Providers;
● to ensure that you can interact with us securely, e.g. we authenticate Users;
● to improve our Platform and develop new features and offerings, including but not limited to troubleshooting software bugs and operational problems; conducting data analysis, testing, and researching; monitoring and analysing usage and activity trends;
● to send you marketing materials that we think will be of interest to you and to personalise your experience with us, including recommendations to features, content, social connections, and advertisements. You can opt-out of receiving marketing materials at any time by contacting us at support@wyldistan.com.
● to prevent fraud and abuse of the Platform, and to protect the rights, property, or safety of Wyldistan, our Customers, Service Provider/s or others;
● to enforce or apply this Privacy Policy, Cookie Policy, Terms of Use, Terms of Service, Content Standards and Guidelines , other terms and conditions or other contracts and/or guidelines of our Platform;
● to exercise our rights, handle any complaints or legal claims as well as defend ourselves from any legal claims;
● to participate in, or be the subject of, any sale, merger or acquisition of all or part of the Wyldistan Platform.

V. HOW WE USE YOUR PERSONAL INFORMATION
The personal data/information collected may be used in the following manner:
A. TRIP RESERVATIONS/BOOKINGS AND CUSTOMER SERVICE:
We may use the information of the registered User, as well as that of the individuals listed as Guests as available in or linked with the User’s account as shared and allowed to be processed and stored to complete and administer any Reservations/Bookings.
This information also includes sending you communications that relate to your Reservation/Booking, such as confirmations (including, where applicable, providing you with a proof of purchase and/or payment), modifications and reminders. In some cases, this may also include processing your personal information to enable online check-in with the Service Provider/s or sharing information about your user account with our customer service staff to respond when you need help to contact the Service Provider and responding to any questions you might have about your Reservation/Booking or any other queries.
We may also use your personal information for several reasons including but not limited to:
● confirming your Reservations/Bookings with respective Service Provider/s either via SMS or Whatsapp or any other messaging service;
● keeping you informed of the Reservation/Booking status;
● sending any updates or changes to your Reservation/Booking;
● allowing our customer service representatives to contact you, if necessary;
● customising the content of our Platform;
● requesting for reviews of products or services listed on our Platform or any other improvements;
● sending verification messages or emails;
● validating and/or authenticating your account to prevent misuse or abuse;
● contacting you on your birthday/anniversary to offer a special gift or offer.
B. ACCOUNT FACILITIES:
Users can register on our Platform by creating an account. We use the information you give us to administer this account, allowing you to browse Listings, manage your Reservations/Bookings, make and share list of your favourite Listing/s, manage your multimedia, provide and view reviews submitted by you, explore special offers, manage your account settings, personalise and customise your experience based on your interactions with our Platform based on your search and booking history, your profile information and preferences and other content you submit with an intention to enable your use of our Platform and the products and services listed thereon.
C. MARKETING PROMOTIONS, RESEARCH AND PROGRAMS:
We may process your information to:
● Send you personalised promotional and marketing messages (for example via push notifications, emails, WhatsApp or other messaging services, etc.) from Wyldistan, including promotions, search assistant messages, rewards, travel experiences, surveys and updates about the various products and services listed on our Platform. You may unsubscribe from receiving email marketing communications quickly, easily and at any time. All you need to do is click on the ‘Unsubscribe’ link included in each newsletter or other communication, or manage your preferences via your account settings;
● Share updates about the products and services listed on our Platform that might be shown to you either on our mobile application, website, or on third-party websites/applications (including social media sites), and the content of the site displayed to you might be personalised. These could include offers and recommendations we think you might find interesting that you can book directly on our Platform;
● Launch and administer referral programs, rewards, surveys, sweepstakes, contests, or other promotional activities or events sponsored or managed by us or our Service Provider/s;
● Marketing promotions, research and programs help us identify your preferences, develop programs, and improve user experience. We may sponsor promotions to give the Users an opportunity to win great travel and travel-related prizes. Personal information collected by us for such activities may include contact information and survey responses. We use such information to notify winners and the survey information may be used to develop promotions and product improvements. As a User, you may also occasionally receive updates from us about sales in your area, special offers, new services hosted on our Platform, other noteworthy items and marketing programs;
● Additionally, we may share your personal information, anonymised and/or aggregated data to a third party that Wyldistan may engage to perform certain tasks on its behalf, including but not limited to data hosting and data processing.
D. SURVEYS AND USER ENGAGEMENT:
We value opinions and comments from our Users and frequently conduct surveys, both online and offline. Participation in these surveys is entirely optional. Typically, the information received is aggregated, and used to make improvements to our Platform, other sales channels, services and to develop appealing content, features and promotions for Users based on the results of the surveys. Identity of the survey participants is typically kept anonymous unless otherwise stated in the survey.
We may use your personal information for analytical purposes and product improvement, such as offering a more personalised experience based on how you use our Platform. Further, your personal information may also be used for the development and enhancement of our machine-learning models and artificial intelligence tools. This is part of our commitment to making our Platform better and enhancing the user experience. In this case, we use data for testing and troubleshooting purposes, as well as to generate statistics about our business. The main goal here is to get insights into how the products and services listed on our Platform perform are used, and ultimately to optimise and customise our Platform, making it easier to use.
We may also invite you to submit reviews and leave feedback during and after your Trip. This invite asks for information about the Service Provider/s, the destination and/or activity. By completing the review, you are explicitly agreeing that it can be displayed in part or in whole (as described in detail in our Content Standards and Guidelines ) on, for example, the relevant Service Provider/s information page on our Platform, and on our social media accounts across various applications. This is to inform other travellers about the quality of the service provided by the relevant Service Provider/s you used, the destination/activity you have chosen or any other experiences you have chosen to share.
E. COMMUNICATIONS:
There might be times when we get in touch with you through multiple avenues, including by email, push notification, chatbot, post, phone, SMS, WhatsApp or other messaging services and/or process communications received from you for various reasons including:
● Responding to and handling any requests made by the User regarding Reservations/Bookings. Wyldistan also offers Customers and Service Provider/s various ways to exchange information, requests and comments about Service Providers and existing Reservations/Bookings via Wyldistan.
● If you have started but not finished a Trip search or Reservation on our Platform, we might contact you to invite you to continue with your search or Reservation/Booking. We believe that this benefits you as it allows you to pick up the process where you left off without having to search for a Service Provider or fill in your reservation details again.
● When you use the products and services listed on our Platform, we might send you a questionnaire or invite you to provide a review about your experience with Wyldistan or the Service Provider/s.
● We may also send you other material related to your Reservations/Bookings and any information that we feel might be useful to you in planning or getting the best out of your Trip. We might also send you material related to your upcoming Reservations/Bookings or a summary of previous Trips you made through our Platform.
● Even if you do not have an upcoming Reservation/Booking, we may still need to send you administrative messages, which could include security alerts.
● In case of misconduct, we may send you a notice and/or warning.
F. PLATFORM DEVELOPMENT:
From time to time we may add or enhance services available on the Platform. To the extent the Platform is used by you, we will use the personal information you provide to facilitate the service/s requested. For example, if you email us with a question, we will use your email address, name, nature of the question, etc. to respond to your question. We may also store such personal information to assist us in making the Platform better and easier to use for our Users.
G. LEGAL PURPOSES:
In certain cases, we may need to use your information to handle and resolve legal claims and disputes, for regulatory investigations and compliance, to enforce this Privacy Policy, Cookie Policy, Terms of Use, Terms of Service, Content Standards and Guidelines , other terms and conditions or other contracts and/or guidelines of our Platform, or to comply with lawful requests from law enforcement. Further, we may process your personal as well as non-personally identifiable information which is linked to your Wyldistan account and device used to access our Platform, as required by relevant laws and regulations.
Providing your personal information to Wyldistan is voluntary. However, we may only be able to provide you with certain services if we can collect some personal information. For instance, we can’t process your Reservation/Booking if we don’t collect your name and contact details, among other information required.
If we use automation to process personal information which produces legal effects or similarly significantly affects you, we will always implement the necessary measures to safeguard your rights and freedoms. This includes the right to obtain human intervention.
In order to process your personal information as described above, we rely on the following legal basis:
As applicable, for the purpose of Section V (A), Wyldistan relies on the legal basis that the processing of personal information is necessary for the performance of a contract, specifically to finalise and administer your Reservation/Booking. If the required personal information is not provided, Wyldistan cannot finalise the Reservation/Booking, nor can we provide customer service.
In view of the purposes of Sections V (B) through (F), Wyldistan relies on its or its third parties’ legitimate interest, to provide and improve services and to prevent fraud and other illegal activities.
When using personal information to serve Wyldistan’s or a third party’s legitimate interest, Wyldistan will always balance your rights and interests in the protection of your personal information against Wyldistan’s rights and interests or those of the third party.
For the purpose of Section V (G), Wyldistan also relies, where applicable, on compliance with legal obligations (such as lawful law enforcement requests).
Finally, where needed under applicable law, Wyldistan will obtain your consent (or as otherwise required by law) prior to processing your personal information, including for cookies and similar tracking technologies and marketing messaging purposes.
Additionally, Wyldistan may collect and/or gather your personal information in the following manner:
1. Providing the best price applicable to you, depending on where you are based: When you search our application/s or website/s, for example to find an accommodation, we process your IP address to confirm your location to offer you the best price for the region or country where you are based.
2. Customer reviews and other destination-related information: If you have a Wyldistan account, please be advised that to foster trust and transparency on our Platform, your name as per your Wyldistan profile will appear next to your review.
3. We may collect personal information about you by monitoring your access to our office premises. By agreeing to enter our office premises you would be agreeing to the required security measures such as verification of your identity, any surveillance (photo/video/audio). If you do not agree to the required security measures, please do not enter our office premises. Please note that Wyldistan or its owners do not have any control over or liability arising from any surveillance (photo/video/audio) conducted by Service Provider/s on their respective premises. If you have any concerns in this regard, you may choose to contact the Service Provider directly before the start of your Booking/Reservation.
4. WiFi: If you use WiFi offered at accommodations provided by Service Provider/s, your login information (which may include your email) and usage information that shows how you use the WiFi may be collected by third-parties not affiliated with Wyldistan. Please note that Wyldistan or its owners do not have any control over or liability arising from your usage of Service Providers’ WiFi.
5. Call monitoring: When you make calls to our customer service team, Wyldistan may use an automated telephone number detection system to match your telephone number to your existing Reservations/Bookings and/or Account with us, to help save time for both you and our customer service staff. However, our customer service staff may still ask for authentication, which helps to keep your details confidential. During calls with our customer service team, live listening might be carried out or calls might be recorded for quality control and training purposes. This includes the usage of the recordings for the handling of complaints, legal claims and for fraud detection. We do not record all calls. In the case that a call is recorded, each recording is kept for a limited amount of time before being automatically deleted. This is unless we have determined that it is necessary to keep the recording for fraud investigation or legal purposes. 6. Promotion of a safe and trustworthy service: To create a trustworthy environment for you, the individual/s you bring with you on your Trip, our Service Providers and the Wyldistan Platform as a whole, we continuously analyse and use certain personal data to detect and prevent fraud and other illegal or unwanted activities. Similarly, we use personal data for risk assessment and security purposes, including when you report a safety concern, or for the authentication of Users and Reservations/Bookings. When we do this, we may have to stop or put certain Reservations/Bookings on hold until we’ve finished our assessment.

VI. SHARING AND DISCLOSURE
We may share your personal information when you provide us with your consent or direct us to share your information, either within the Contracting Entity and/or its owned/affiliated companies, if any and with other Service Provider/s who list their products and services on our Platform. We also share your information in accordance with the law. For more information on whom we share your information with, please expand this section .
We share your information for the purposes set out in this Privacy Policy, with the following categories of recipients:
● members of the Contracting Entity and its owned/affiliated companies if any;
● Service Provider/s who list their products and/or services on our Platform, or third-parties who have partnered with Wyldistan in connection with services provided on our Platform or a relevant promotional offering, as well as other applications/websites that integrate with our API or Services, or those with an API or Service with which we integrate;
● third-parties to whom we have a duty to or are permitted to disclose your personal information by law, including but not limited to law enforcement officials, police in the exercise of their functions or with others statutory authorities or as may required by an order of a competent court;
● third-parties to whom the Contracting Entity may sell or buy any business or assets, in which case we may disclose your personal information to the prospective seller or buyer of such business or assets;
● third-parties in connection with any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of the Contracting Entity and its owned/affiliated companies’ business, in which case personal information held by it about its customers or visitors to the website may be one of the transferred assets.
● third-parties engaged by us to perform certain tasks on our behalf, including but not limited to payment processing, customer service, data hosting and data processing platforms, and marketing and advertising agencies.
We may use non-identifiable personal information of Users in aggregate or in anonymised form to build higher quality, more useful online services by performing statistical analysis of the collective characteristics and behaviour of our Customers, Guests and overall Users, and by measuring demographics and interests regarding specific areas of the mobile application/website. We may provide anonymous statistical information based on this data to suppliers, advertisers, affiliates and other current and potential business partners. We may also use such aggregate data to inform these third parties as to the number of people who have seen and clicked on links to their websites. We do not use, sell, trade, or otherwise exploit your personal information which we collect except otherwise as contained in this Privacy Policy. We may use and/or share such anonymized and generic aggregated information, not linked to any personally-identifiable information at our sole discretion and without any compensation to you, for any legitimate purpose including without limitation the commercial sale thereof to third-parties. Where we share your personal information, appropriate protections will be in place to protect your personal information as required by data protection laws. Sometimes, we may share information in an aggregated, pseudonymised and/or anonymised form which cannot reasonably be used to identify an individual.
There are different parties integrated into Wyldistan’s services, in various ways and for various reasons. The primary reason we share your data is to facilitate the ease of access of our Platform and enable Service Provider/s with the relevant information so as to provide the registered Users as well as individuals listed as Guests with an effortless user journey for Reservations/Bookings. .
A. HOW WE SHARE YOUR PERSONAL INFORMATION WITH THIRD-PARTIES
We may share your personal information with third-parties (including but not limited to the ones listed hereinbelow) in the following manner:
1. The Service Provider whose Listings you may browse, favourite and/or book::
● In order to complete your Reservation/Booking, we transfer relevant details to the Service Provider whose products/services you have booked through our Platform. This is one of the most essential things we do for you. Depending on the Reservation/Booking and the Service Provider, the details we share may include your name, contact and payment status, names of the Guest/s accompanying you and any other information or preferences you specified when you made your Reservation/Booking.
● In certain cases, we may also provide some additional historical information about you to the Service Provider. This includes whether you’ve already booked with them in the past, the number of completed bookings you’ve made with Wyldistan, background checks, fraud prevention, a confirmation that no misconduct has been reported about you, the percentage of bookings you’ve cancelled in the past or whether you’ve given reviews about past Reservations/Bookings.
● In case of any queries regarding your Trip, we may contact the Service Provider/s and connect them with you to handle your request directly.
● In cases of any claims or disputes related to your Reservation/Booking, we may provide the Service Provider/s with your contact details and any other necessary information as required to resolve the situation.
● It may be possible that the Service Provider/s may further process your personal information outside of the control of Wyldistan, for instance to provide additional services, or to comply with local restrictions. Please note that any additional information provided to the Service Provider/s shall be governed under their respective Privacy Policy that they may share directly with you. You are required to review the same to understand how they process your personal information and Wyldistan does not control the usage of such information beyond the scope of this Privacy Policy and shall therefore not be responsible and/or liable in any manner whatsoever for any disputes/differences arising from the use of your personal information by the respective Service Provider/s.
2. Third-Party Vendors: Please note that we may need to engage and share your personal information with certain third-party vendors in order to finalise and administer your Reservation/Booking. Such vendors may act on behalf of Service Provider/s and/or Wyldistan to enable/assist them to manage their Reservations/Bookings or other business and/or administrative requirements. For example: (i) Any information shared by the Service Provider/s in provision of ancillary services in order to facilitate your Reservation/Booking; (ii) Any information shared by you either by way of a testimonial, among others, may be shared with third-parties engaged by our Platform. Such third-party vendors may provide us services that include but may not be limited to:
● Customer support;
● Market research, marketing and advertising;
● Fraud detection and prevention (including anti-fraud screening);
● Payment gateway and refund processing.
We use third-party vendors to process payments, handle refunds or provide billing collection services. When a refund is requested for your Reservation/Booking, either by you or by the holder of the payment instrument used to make your Reservation, we need to share certain reservation details with the Payment Gateway and the relevant financial institution so they can handle the refund. This may also include a copy of your Reservation/Booking confirmation and/or the IP address used to make your Reservation/Booking. We may share such information with relevant financial institutions, if we consider it strictly necessary for fraud detection and prevention purposes.
3. Corporate Requirements: To support the use of our Platform, your personal information may be shared with companies owned by and/or affiliated with Contracting Entity.
4. Marketing Services
● We may share personal information, including but not limited to, your email address, IP address and telephone number with advertising companies as part of marketing of the Platform and/or the Listings hosted thereon. We may provide these services via third party vendors to ensure that relevant advertisements are shown to the right audience, using various techniques such as hashing to enable the matching of your email address, IP address and/or telephone number with an existing customer database, which prevents your information from being used for other purposes. ● We may use your personal information to send you marketing by post, telephone, social media platforms, email, SMS, application notifications and silent notifications to track installation status of our application. We may also use your personal information to carry out online paid marketing activities in the nature of retargeting.
● We may also use technology to help us understand your personal preferences and interests so that we can send recommendations and marketing communications that are likely to be of more interest to you.
● You will occasionally receive updates via e-mails/messages from us about offers and discounts, new listings and services provided on our Platform. We hope you will find these updates interesting and informative. If you wish not to receive them, please click on the “unsubscribe” link or follow the instructions in each e-mail message or by adjusting the settings on your device to turn off notifications from our app. Alternatively, you can always contact us at support@wyldistan.com to update your contact preferences.
5. Analytics and Advertising Vendors
● We may use advertising vendors, such as metasearch providers, to allow you to compare our offers with offers from other Online Travel Agencies (OTAs).
● Third-party vendors may provide us with audience measurement and analytics services that analyse your online interactions (both with the Wyldistan and other platforms, applications or websites), to serve you with tailored marketing and report on the performance of that marketing. ● We may allow third-parties to provide audience measurement and analytics services for us, to serve advertisements on our behalf across the Internet, and to track and report on the performance of those advertisements. These entities may use cookies, web beacons, SDKs, and other technologies to identify your device when you visit our Platform, as well as when you visit other online sites and services. For more information about these technologies and third-party vendors, please refer to our Cookie Policy .
6. Other professional third parties: In certain cases (such as disputes or legal claims or as part of auditing activities), we may need to share your personal information with professional advisors. These advisors include without limitation parties such as law firms or auditors. We only share your personal information to the extent that is necessary and such third parties process this information in line with their own professional obligations.
7. Competent authorities: We disclose personal information to law enforcement to the extent that it is required by law or is strictly necessary for the prevention, detection or prosecution of criminal acts and fraud. We may need to further disclose relevant personal information to competent authorities (including tax authorities and municipalities) to comply with legal obligations, to protect and defend our rights, or the rights and properties of our Service Provider/s.
B. DISCLOSURE OF INFORMATION
In addition to the circumstances described above, we may disclose a User's personal information if required to do so in the following circumstances:
● by law, required by any enforcement authority for investigation, by court order or in reference to any legal process;
● to conduct our business;
● for regulatory, internal compliance, and audit exercise/s;
● to secure our systems;
● to enforce the rights and/or protect the properties of Contracting Entity, or any or all of its affiliates, associates, employees, directors or officers or when we have reason to believe that disclosing Personal Information of User(s) is necessary to identify, contact or bring legal action against someone who may be causing interference with our rights or properties, and/or of the Service Provider/s listed on our Platform, whether intentionally or otherwise, or when anyone else could be harmed by such activities; or
● when an insurance claim is made concerning you and a Service Provider, we may provide the necessary information (including personal information) to the insurance company for further processing of such claim.
Such disclosure and storage may take place without your knowledge. In that case, we shall not be liable to you or any third party for any damages howsoever arising from such disclosure and storage.
C. HOW DOES WYLDISTAN PROCESS COMMUNICATIONS THAT YOU AND YOUR BOOKED SERVICE PROVIDER EXCHANGE VIA OUR PLATFORM?
Wyldistan may offer you and Service Provider/s various ways to communicate about the Facilitation Services and existing Reservations/Booking, directing the communications via our Platform. This also allows you and your Service Provider to contact us with any questions/queries about your Reservation/Booking through our mobile application, website and any other channels that we make available.
Wyldistan accesses communications and may use automated systems to review, scan, and analyse communications for the following reasons:
● Security purposes
● Fraud prevention
● Compliance with legal and regulatory requirements
● Investigations of potential misconduct
● Product development and improvement
● Research
● Customer engagement (including to provide you with information and offers that we believe may be of interest to you)
● Customer or technical support
We reserve the right to review or block the delivery of communications that we, in our sole discretion, believe might contain malicious content or spam, or pose a risk to you, Service Providers, Wyldistan or others.
All communications sent or received using Wyldistan communication tools will be received and stored by Wyldistan. The Service Provider/s whose Listings you’ve booked/reserved might also choose to communicate with you directly by email or through other channels that Wyldistan does not control. The processing of any such communication and personal information shared by you during such communications shall be governed under the respective Privacy Policy of such Service Provider/s.

VII. PERMISSIONS REQUIRED FOR THE USAGE OF OUR MOBILE APPLICATION
When the Wyldistan application is installed on your device (phone/tablet), for the purpose of its effective functionality, certain permissions are mandatorily required which collect and access your personal information as contained in the present Privacy Policy.

VIII. HOW WE PROTECT YOUR PERSONAL INFORMATION
We have implemented a range of procedures to prevent unauthorised access to and the misuse of personal information collected, processed and/or stored by us. Wyldistan is not responsible for the protection or the nature of the use of the User’s personal information beyond its Platform. If you do not agree to this usage of your personal information, please do not access our platform. All payments will be through the external Payment Gateway, the terms relating to which may be accessed in Payment Gateway Provider’s privacy policy and Wyldistan shall not be responsible and/or liable for the same. We also employ stringent security measures to protect the loss, misuse, and alteration of the information under our control. Whenever you change or access your account information, we offer the use of a secure server. Once your information is in our possession, we adhere to strict security guidelines, protecting it against unauthorised access.
In general, we may retain your information in accordance with our records retention policies. However, there may be circumstances where we must retain your personal information for periods longer than as stipulated under such policies. To determine the longevity of the retention of your personal information, we calculate retention periods in accordance with the following criteria:
● the currency of your relationship with us and the types of products or services listed on our Platform which are utilised by you;
● the reasonable period of time to retain records so as to demonstrate that we have fulfilled our obligations to you and under law;
● the legitimate interest/s of the Contracting Entity and/or Service Provider/s without overriding your rights and freedoms under this Privacy Policy;
● in public interest, scientific or historical research, or statistical purposes, for archiving purposes provided appropriate safeguards are implemented to protect individual rights;
● any limitation period/s within which claims might be made;
● any retention period/s prescribed by law or recommended by regulators, industry bodies or associations; and
● the existence/pendency of any relevant proceedings;
● enhancement of operational efficiency and improvement of customer service based on historical interactions.

IX. YOUR RIGHTS
As a registered User of our Platform, you are entitled to exercise any of the rights described in this section consistent with applicable law provided that you meet the eligibility criteria of accessing and using our Platform:
A. Right to information: You can request information/details from us as to how your personal information is being processed and the same shall be made accessible to you, including information but not limited to:
● a summary of personal information being processed by us;
● the identities of all and/or any other Service Provider/s or Third-Party Enablers with whom such personal information has been shared by us, along with a description of the personal information shared; and
● any other information related to such personal information and its processing, as may be prescribed under law.
B. Managing your information: You can access, correct, update, and/or delete your personal information (except certain mandatory fields required for your continued access to our Platform) through your user account settings directly. You shall be responsible for keeping your personal information and that of your Guests up to date on the Platform, and inform any changes to the Service Provider/s directly for any current/future Booking/Reservation.
C. Withdrawal of consent and permission: You may withdraw your consent to submit any or all personal information or decline to provide any permissions to our Platform as covered above at any time. In case, you choose to do so then your access to our Platform may be limited, or we might not be able to provide the requested services to you. You may withdraw your consent by sending an email to support@wyldistan.com.
D. Right to correction and erasure: If you wish to correct and/or remove your personal information from our Platform, you have the right to request the same, including but not limited to (i) correct inaccurate data about you; (ii) update personal data retained about you; (iii) request deletion of your personal data. However, please note that such erasure, in part or in whole, will remove such personal information from our Platform (except as specifically stated in this Policy) and may result in deletion of your account on the Platform permanently, and the same may not be retrievable.
E. Limit communications you receive from us: You may also have the option to choose what kind of communication you would like to receive from us. However, there may be certain communications that are required for legal or security purposes, including changes to various legal agreements, that you may not be able to limit.
F. Reject Cookies and other similar technologies: You may reject or remove cookies from your web browser as you will always have the option to change the default settings on your web browser if the same is set to ‘accept cookies’. However, please note that some of the services/products offered on our Platform may not function or be available to you, when the cookies are rejected, removed or disabled. G. Right to Grievance/Redressal: You are entitled to register a grievance/complaint towards any inconvenience faced by you while accessing our Platform and/or while using any products and services provided by the Service Provider/s listed on our Platform. However, as a preliminary requirement under law, you are required to exhaust such a right primarily with us before taking any further steps for redressal.

X. CROSS-BORDER TRANSFER
Wyldistan uses global information systems in the course of its business. As a result, Wyldistan may store, process and transfer your personal data/information either on servers located in India or other countries depending on the location of our affiliates and/or Service Provider/s.
Wyldistan takes steps to ensure that when your personal data/information is transferred internationally, it is subject to appropriate safeguards in accordance with data protection laws. Often, these safeguards include contractual safeguards. The data that we collect from you, as described in this Privacy Policy may be made accessible from, transferred to or stored in countries which may not have the same data protection laws as the country in which you initially provided the information.
Please note that in such an instance, your personal data/information as stored, processed, and transferred by us can become subject to the laws and disclosure requirements of such countries, including disclosure to governmental bodies, regulatory agencies, statutory authorities, and private persons, as a result of applicable governmental or regulatory inquiry, court order or other similar process.

XI. CHANGES TO THE PRIVACY POLICY
We reserve the right to modify, revise, or change this Privacy Policy at any time in accordance with applicable law. If we do so, we will post the revised Privacy Policy and update the “Last Updated” date at the top. We encourage you to check our Platform frequently to see the recent changes. Unless stated otherwise, our current Policy applies to all information that we have about you. If you disagree with the revised Privacy Policy, you can withdraw your consent and/or delete your Account on the Platform, to the extent that there is no outstanding obligation from you to Wyldistan and/or our Service Provider/s (for example unresolved disputes that may or may not result in damages owed by you). In case of your failure to withdraw your consent and/or delete your Account before the effective date of the revised Privacy Policy, your continued access to or use of our Platform will be deemed to be subject to the revised Privacy Policy.
